Wisconsin
Legislative Council debunks Wisconsin Right to
Life's main argument against personhood amendment
The Wisconsin Legislative Council (WLC), a
non-partisan service agency that provides legal
services to the Wisconsin Legislature, drafted a
memo for State Representative Andre Jacque
addressing the implications of the Wisconsin
Personhood Amendment (Assembly Joint Resolution
[AJR] 77) on Wisconsin’s pre-Roe v. Wade
criminal abortion ban (Wis. Stats. 940.04).
Representative Jacque, author of the personhood
amendment, released the WLC memo
to his fellow legislators this morning
along with his own memo
summarizing their conclusions.
Wisconsin Right to Life’s central argument
against introduction and passage of a personhood
constitutional amendment is that it would
overturn by “implied repeal” Wisconsin’s pre-Roe
criminal abortion statute. The WLC concludes
the opposite.
Citing United States and Wisconsin Supreme Court
case law, the WLC memo states that it is
unlikely that 940.04 would be vacated in its
entirety by implied repeal. If anything were to
be impliedly repealed (and that’s a big if), it
would be only those sections of 940.04 that may
conflict with the equality provision in the
amendment – for example, the life-of-the-mother
exception and the differing penalties for
killing a quick versus non-quick child. And
removing these inequitable sections would only
strengthen 940.04!
Rep. Jacque states in his memo that, “I
therefore agree with the WLC when it states in
its memo that ‘the statute appears to complement
rather than conflict with the proposed
constitutional amendment, insofar as the
amendment expands the inherent right to life
recognized in the Wisconsin Constitution to
unborn persons and the statute provides a basis
for criminal liability for harm to such
persons.’”
Given the WLC’s
conclusion, Pro-Life Wisconsin hopes that
Wisconsin Right to Life will promptly remove
its opposition to the Wisconsin Personhood
Amendment. It is clear that AJR 77
would not harm Wisconsin Statutes 940.04 by
“implied repeal” or otherwise. Accordingly,
concerns over 940.04 should not stand in the way
of supporting PLW’s personhood amendment.

Amendment campaign.

Manger
Danger: Affiliated Medical Services called 911 to
report manger, Christmas carolers
We have written about
what unfolded at our Empty Manger Christmas
Caroling event at Affiliated Medical Services in
Milwaukee on Friday, December 23.
An open records request made to the Milwaukee
Police Department turned up the 911 call made by
Affiliated staff on that day. You read that
right — Affiliated called 911 to report
Christmas carolers and a manger in front.
Watch a video with the 911 call here.
Why are the pro-aborts so scared of the baby
Jesus?
In Wisconsin, officers may issue a citation to a
person for calling 911 for a
non-emergency/frivolous situation, as this
clearly was (and still doesn’t explain how the
call warranted the police response.)
Affiliated is the same abortion facility where
staff were seen laughing
and dancing after an ambulance took a woman to a
nearby hospital after a botched abortion.

Vigil
for Life marks one-year anniversary of daily
witness outside Madison Planned Parenthood
On January 3, Vigil for Life,
Pro-Life Wisconsin’s Dane County affiliate,
celebrated the one-year anniversary of its 365
for Life initiative, which has brought prayer
warriors and sidewalk counselors to Madison’s
Planned Parenthood abortion facility on a daily
basis.
“Five 40 Days
for Life vigils showed us the power of prayer
and peaceful witness at Planned Parenthood and
convinced us that 40 or 80 days a year aren’t
enough,” said Vigil for Life President Laura
Karlen. “We realized we need to be there every
day abortions take place.”
In 2009 and
2010, Vigil for Life helped lead the successful
statewide campaign to end late-term abortion
plans at the Madison Surgery Center. But after
victory was secured, Karlen set her sights on a
new goal.
“We wanted to
make sure that any woman who comes to Planned
Parenthood has a chance of benefiting from the
prayers and counseling of our vigil
participants,” Karlen said. “With 365 for Life,
we’ve accomplished that goal, talking with and
praying for countless abortion and
contraception-vulnerable women.”
Organizers
weren’t initially sure how a year-round vigil
would go, but they placed their trust in the
Lord and forged ahead, even launching the
campaign in the midst of winter. Since then, the
fruits of Vigil for Life’s efforts have been
abundant. Consider a story from this past
November: Will Goodman and Elise Rose — two
seasoned sidewalk counselors — struggled to
communicate with an abortion-minded woman who
didn’t speak English. They got Karlen, who is
fluent in Spanish, on the phone. After talking
with Karlen, the young woman made the decision
to leave Planned Parenthood.
“It’s a
challenging apostolate, and the winter months
make the hours difficult to fill at times,”
Karlen said. “But with the Lord’s grace, we’ll
be out here until abortion is ended!”
