State Senate Passes Fetal Pain Bill with Life-of-the-Mother Exception


On Tuesday June 9, 2015, the Wisconsin Senate passed the Pain-Capable Unborn Child Protection Act on a 19-14 party-line vote. Senate Bill (SB) 179 would prohibit direct abortion at or beyond 20 weeks based on the preborn child’s capacity to feel pain at that gestational age.  Regrettably, the legislation includes a medical emergency / life-of-the-mother exception that was further confirmed / clarified in an amendment offered by bill author and State Senator Mary Lazich (R-New Berlin) and adopted by the full Senate.

Pro-Life Wisconsin supports legislation shielding preborn children from the excruciating pain of late-term dilation and evacuation dismemberment abortions. But we could not support SB 179 because it includes an exception for a “medical emergency,” as defined in section 253.10 of the Wisconsin Statutes. Because the term medical emergency is defined to allow direct abortion, the medical emergency language in the bill constitutes an unacceptable life-of-the-mother exception.

Senate Bill 179 now heads to the State Assembly which could take up the bill this month or sometime in the fall. State Representative Janel Brandtjen (R-Menomonee Falls) has introduced an amendment that would remove the medical emergency / life-of-the-mother exception in the legislation, but there are not enough votes in the Assembly to adopt it.

The life-of-the-mother exception in SB 179 is a patent denial of equal protection under the law. We must never codify the importance of one innocent human life over and above another. Physicians must provide equal care for mother and child, and must never be given license to intentionally kill either one of them.

There are no situations where abortion, defined as the direct and intentional killing of an unborn child, is medically necessary to save the life of the mother. Over 900 pro-life doctors and medical researchers have signed the Dublin Declaration, a document stating that abortion is never medically necessary to save a mother's life.

  • Save the date – Saturday, October 17, 2015.  We are very excited about this year’s event at the beautiful Harley-Davidson Museum and about our keynote speaker, Abby Johnson.
  • Spread the word and invite your friends. Put a table of 10 people together!
  • Volunteer! We need people to coordinate different tasks or simply help with various activities, such as help in the weeks prior to the event, setting up the morning of the event, or help during the event. If you have questions, please email or call Bonnie! It doesn’t have to be a huge amount of time and we need many talents.
  • We need items! Ask businesses you frequent if they would donate a gift certificate or item to our worthy cause. Themed baskets do well. Possible gift basket ideas include liquor, food, BBQ accessories, men themed baskets, hunting, cigars, sporting goods, spa certificates or baskets, chocolate lovers baskets, coffee lovers, gift wrap, and baby items. Be creative!

The July All-Night Vigil of Reparation will be at Sacred Heart Croatian Church, 49th and Wells Street, Friday and Saturday, July 3rd & 4th. Confessions will be heard between 7:00 and 8:00, before the opening Mass which begins at 8, followed by a procession with the Blessed Sacrament. Adoration, talks, community prayers, Holy Hour for life, and confessions throughout the night, concluding with First Saturday Mass at 5 AM.
